ESA LETTER FLORIDA
What Is an Emotional Support Animal Letter in Florida?
An ESA letter in Florida is a signed letter from a licensed mental health clinician. It supports your request to keep an emotional support animal as a housing accommodation under the Fair Housing Act and Fla. Stat. § 760.27. Florida has no official ESA registry.
A clinician writes the letter only after evaluating you and finding a disability-related need for the animal. Ours costs $99 flat, with no subscription or upsells. The eligibility quiz is free, and you get a full refund if the clinician finds you don't qualify.
In Florida, the clinician behind yourESA letterneeds personal knowledge of your disability and must act within their scope of practice, under § 760.27(2)(b)4. That is the whole legal test. Florida sets no 30-day waiting period and no expiration date.
An emotional support animal letter Florida landlords can rely on also lists the clinician's license type, number, state and date.

Do You Qualify for an Emotional Support Animal in Florida?
Only a licensed clinician can decide that, after evaluating you. Under Florida law, a disability is a mental or physical impairment that substantially limits one or more major life activities (Fla. Stat. § 760.22(3)). The clinician also looks at whether your animal helps with that condition.
Conditions clinicians often evaluate include:
Florida ESA Laws: What Fla. Stat. § 760.27 Says
Florida's ESA law is Fla. Stat. § 760.27, passed as SB 1084 and in force since July 1, 2020. It works alongside the federal Fair Housing Act and applies to the extent federal law requires.
Federal and State Housing Protection
Under 42 U.S.C. § 3604(f)(3)(B) and Fla. Stat. § 760.23(9)(b), refusing a needed reasonable accommodation counts as housing discrimination.
No-Pet Rules Can Bend
In Bhogaita (11th Cir. 2014), a federal appeals court upheld a verdict for a Florida condo resident whose emotional support dog exceeded a 25-pound limit.
No Extra Charge for Your ESA
Fla. Stat. § 760.27(2) says you may not be required to pay extra compensation for the animal.
Florida Service Dog Laws Exclude ESAs
Florida service dog laws, Fla. Stat. § 413.08, cover trained dogs and miniature horses. ESAs get no right to enter stores or restaurants.
Florida ESA Registration Is a Myth
Under § 760.27(3)(c), an online emotional support animal registration, ID card or certificate is not, by itself, sufficient proof.
Florida ESA Requirements: What Landlords Can and Can't Ask
Your rights come from two laws working together: the federalFair Housing ActandFla. Stat. § 760.27. Together they let you ask for a reasonable accommodation, and they limit what a landlord may request in return.
Proof Only When Not Obvious
A landlord may request reliable information only when your disability or your need for the animal is not readily apparent (§ 760.27(2)(b)–(c)).
No Diagnosis or Medical Records
The landlord may not ask for your diagnosis, how severe it is, or your medical records. You can share them if you choose.
No Forced Forms or Notary
A landlord cannot require a specific form or a notarized statement, or deny you only for skipping its usual process.
Vaccination and Licensing Proof
A landlord may ask for proof that each ESA meets state and local licensing and vaccination rules.
Direct Threat to Others
A landlord may deny an animal that poses a direct threat to others' health, safety or property that no other accommodation can reduce.
Weak or Missing Documentation
If your disability isn't obvious and your only proof is an online registration, the landlord can decline.
Small Landlords May Be Exempt
Under § 760.29(1)(a), § 760.27 does not reach owner-occupied buildings of four units or fewer, or some single-family rentals.
AIR TRAVEL
Can You Fly With Your ESA From Florida?
Yes, but usually as a pet. The DOT's 2020 rule, effective January 11, 2021, lets airlines treat ESAs as pets.
For your trip, that usually means:
- Your ESA flies under the pet policy
- The airline may charge a pet fee
- Carrier, size and breed limits can apply
- Check each airline's own rules first
Your ESA letter still supports a housing request, but it gives no right to cabin travel.
What Happens If You Fake an ESA in Florida?
Florida made ESA fraud a crime in 2020. The same bill, SB 1084, shaped both the housing rules inFla. Stat. § 760.27and penalties inFla. Stat. § 817.265. The crime covers tenants who lie and anyone who falsifies paperwork for them.

FAQs
Florida ESA Questions, Answered
Yes, but only on limited grounds. A landlord may deny an animal that poses a direct threat no other accommodation can reduce, or ask for reliable proof when your disability or need isn't obvious. Small owner-occupied buildings and some single-family rentals fall outside § 760.27.
Many do, and Florida law lets them ask for reliable information when a disability is not readily apparent. They can confirm that your clinician holds an active license. They cannot demand your diagnosis, your medical records, a notarized statement or their own form.
It can be. Under § 760.27(2)(b)4, information from a licensed practitioner who has personal knowledge of your disability and acts within their scope of practice counts as reliable. The letter does not need to name your diagnosis.
Your dog needs no special training, and it can be a pet you already own. It becomes your ESA for housing when a licensed clinician finds that you have a disability and that the animal helps with it. There is no registry to join.
Get it from a licensed clinician who evaluates you one-on-one. For proof of disability, Florida accepts Florida-licensed practitioners, registered Florida telehealth providers, and out-of-state licensees who have seen you in person at least once. Registration sites, ID cards and certificates are not, by themselves, enough.
No. Fla. Stat. § 760.27 sets no 30-day rule, no minimum number of sessions and no expiration date for a letter. The legal test is that the clinician has personal knowledge of your disability and acts within their scope of practice.
Our housing ESA letter costs $99 flat, with no subscription, auto-renewal or upsells, and the eligibility quiz is free. Your landlord may not charge extra compensation for the ESA, but you still pay for any damage it causes.
No. A psychiatric service dog is trained to perform specific tasks, and Fla. Stat. § 413.08 gives service animals access to public places. An ESA needs no training and has housing protection only. If your dog is task-trained, ask about our PSD letter instead.
Yes. You can file for free with the Florida Commission on Human Relations within 1 year (Fla. Stat. § 760.34), or sue within 2 years (§ 760.35). HUD's May 2026 memo says HUD will find cause only for trained animals, but it did not change the Fair Housing Act or your right to sue.
Real ESA letters are rarely free, because a licensed clinician has to evaluate you. Free templates carry no weight, since no clinician with personal knowledge of your disability stands behind them. Your ESA can be a pet you already have.
