ESA LETTER GEORGIA
What Is an ESA Letter, and Is There ESA Registration in Georgia?
An ESA letter is a signed statement from a licensed mental health clinician. It confirms that you have a disability-related need for an emotional support animal. In Georgia, you use it to request a housing accommodation under the federal Fair Housing Act and the Georgia Fair Housing Law.
Georgia has no separate ESA statute. O.C.G.A. § 8-3-202(a)(7)(B)(ii) treats refusing a needed, reasonable accommodation as housing discrimination.
There is no emotional support animal registration in Georgia: no state registry, ID card or certificate. Our letter costs $99 flat, fully refunded if you don't qualify.
How Do You Get an ESA in Georgia?
Getting an ESA letter in Georgia happens entirely online, from home. There are four steps, and the first is a free five-minute quiz.
Answer a Short Quiz
Tell us about your symptoms, your daily routine and what your animal does for you. Nothing is charged at this stage.
Talk With a Clinician
A clinician licensed in Georgia meets you one-on-one by video, phone or secure online visit. Georgia's counseling telehealth rule requires your consent and a careful assessment first.
Get a Signed Letter
If you qualify, your letter carries the clinician's name, license type, license number, state and date on professional letterhead. It usually arrives within 24–48 hours.
Send Your Request
Email the letter to your landlord with a short written accommodation request, and save copies. Out-of-state owners of houses and duplexes must name a Georgia contact for tenants (§ 44-7-25).
Who Qualifies for an Emotional Support Animal in Georgia?
Qualifying depends on how a mental or emotional condition limits your life and how your animal eases it. Georgia law defines disability as an impairment that substantially limits a major life activity (O.C.G.A. § 8-3-201).
A licensed clinician can assess your need for an ESA if you live with conditions such as:
Georgia ESA Laws: What Protects Your Housing Request?
Georgia ESA laws start with fair housing, since the state has no ESA statute. Your rights rest on the federal Fair Housing Act and its state mirror; § 8-3-223 makes federal compliance count as Georgia compliance.
No-Pet Rules Can Bend
The state's Georgia Landlord-Tenant Handbook lists waiving a no-pet policy for an assistive animal as a typical accommodation. A letter from a PetESALetter clinician supports that request.
Pet Deposits Follow Deposit Law
No Georgia statute bans pet fees for an ESA, so ask for a waiver. A refundable pet deposit counts as a security deposit (§ 44-7-30), inside the two-month cap (§ 44-7-30.1).
Your Diagnosis Stays Private
No Georgia statute lists what a landlord may demand. Your letter can confirm your need without a diagnosis; even the state's voucher form tells verifiers not to give one.
Deadlines to Challenge a Denial
You can file with the Georgia Commission on Equal Opportunity within one year (§ 8-3-208). You can also sue in superior court within two years (§ 8-3-217).
Retaliation May Be Barred
O.C.G.A. § 44-7-24 bars retaliation, such as an eviction filing or a rent hike, within three months after a tenant uses a legal right in good faith. That may include an accommodation request.
Which Georgia Rentals Does Fair Housing Law Cover?
The federal Fair Housing Act and the Georgia Fair Housing Law apply in every county. What matters is the type of property and who owns it, and a few small landlords are exempt.
Apartment Communities
Apartment complexes are covered. An owner of any building for five or more families counts as "in the business" (§ 8-3-202(c)).
Single-Family Rental Homes
A rented single-family home is covered whenever the owner uses a broker or agent, or owns more than three single-family rental homes.
HOAs and Condos
Association pet rules are policies too, so you can ask for an accommodation. SB 406 adds HOA registration and complaints in 2027.
Dorms and Student Apartments
Campus housing is housing too. Many colleges run their own ESA request process, so contact the school's accommodations office well before move-in.
Owner Lives On Site
If the owner lives in one unit of a building for four or fewer families, Georgia's fair housing law exempts that rental (O.C.G.A. § 8-3-202(b)).
Small Owner, No Agent
A private owner of three or fewer single-family homes who rents without a broker or agent, and without discriminatory ads, is also exempt.
Religious Groups and Clubs
Housing a religious group or private club reserves for its members may fall under narrow limits in O.C.G.A. § 8-3-205.
TRAVEL & TRANSIT
Can You Fly or Ride Transit With an ESA From Georgia?
Not with legal cabin rights. The U.S. Department of Transportation's Air Carrier Access Act rule took effect January 11, 2021. Airlines may now treat an emotional support animal like any pet, with pet fees, carrier sizes and cabin limits.
Your housing rights did not change with that rule. An ESA letter is a housing document, not a boarding pass. People with task-trained psychiatric service dogs follow separate DOT rules and forms.
On the ground, Georgia's service dog law (§ 30-4-2) opens buses, hotels and other public places to trained service dogs only. ESAs are left out, so each carrier or business applies its own pet policy.
Georgia Service Dog Laws: What Changed on July 1, 2026?
HB 668, the Mara Jade Act (Act 440), took effect July 1, 2026. It rewrote Georgia service dog laws. Georgia still has no ESA fraud crime, but the new law draws a sharp line that every ESA owner should know.

Not by itself. It is a clinician's statement of your disability-related need for the animal, usually naming no diagnosis.
Possibly; no Georgia statute bans it, so ask for a waiver. A refundable pet deposit counts toward the two-month cap and is due back within 30 days (§ 44-7-34).
HUD withdrew its 2013 and 2020 animal notices effective September 17, 2025. In a May 22, 2026, memo, HUD limited its findings to trained animals; the Fair Housing Act is unchanged.
