A landlord is allowed to ask two things when your disability is not obvious:

1. Do you have a disability that limits a major life activity
2. Do you have a disability-related need for the animal

They cannot ask for your medical records, your specific diagnosis, or details about your treatment. They also cannot charge a pet deposit for a legitimate service animal under the ADA. When Landlords Can Deny a Helper Dog

A landlord can lawfully deny a request when:

• The animal poses a direct threat to health or safety that cannot be reduced by other accommodations
• The animal would cause substantial physical damage to the property
• Your documentation is clearly fraudulent or from an unlicensed source
• The specific animal is not the type or size reasonably needed for your condition
• Under the 2026 guidance, they simply choose not to extend a voluntary accommodation to an ESA, since it is no longer a mandatory carve-out the way it was under the 2020 rule

Flying With a Helper Dog for Anxiety

As of DOT 2021 rule, that remains in force through 2026, the airlines are not required to accept the emotional support animals in the cabin for free.
