ESA LETTER ALASKA

What Does an ESA Letter Do for Alaska Renters?

Alaska renter relaxing at home with an emotional support dog

An ESA letter is a signed note from a licensed mental health clinician. It states that you have a mental or emotional disability and that your emotional support animal helps you manage it.

In Alaska, the letter supports a housing accommodation request under the federal Fair Housing Act and the state Human Rights Act, Alaska Stat. § 18.80.240. There is no official registry, so ID cards and online certificates carry no weight.

The letter costs $99 flat, paid at checkout, and the eligibility quiz is free. If the clinician finds you don't qualify, you get a full refund. There is no subscription and no auto-renewal.

THE PROCESS

How Do You Get an ESA in Alaska?

PetESALetter runs the emotional support animal letter Alaska process online in four steps, and a licensed clinician makes every eligibility decision.

Take the Free Eligibility Quiz

Tell us about your symptoms, your routine and the animal that steadies you. It takes about five minutes and gives the clinician context before you talk.

Meet an Alaska-Licensed Clinician

State law lets its own licensed providers treat patients by telehealth without an in-person visit (AS 08.02.130). Your evaluation happens by video, phone or secure online session.

The clinician decides whether your condition limits daily life and whether an animal helps. Not everyone qualifies, and the clinician can say no.

Send the Letter With Your Request

If you qualify, the signed letter usually arrives within 24 to 48 hours. Attach it to a written accommodation request. It supports your request but cannot force an outcome.

WHO QUALIFIES

Who Qualifies for an Alaska ESA?

Alaska law counts “emotional or mental illness” as an impairment. It becomes a disability when it substantially limits a major life activity (AS 18.80.300(14)–(15)). A licensed clinician decides whether that describes you and whether an animal helps.

Clinicians often assess conditions such as:

Agoraphobia
Generalized anxiety
PTSD and trauma symptoms
Panic disorder
Obsessive-compulsive disorder
Bipolar disorder
Social anxiety
Seasonal affective disorder
Adjustment disorder
Major depressive disorder
You do not need years of therapy first. No Alaska statute or regulation sets a 30-day rule, a minimum number of sessions or an in-person visit for ESA paperwork. What counts is a genuine, current evaluation.
ALASKA LAW

Alaska ESA Laws: What Actually Applies?

Alaska has no emotional support animal statute. Your housing rights come from Alaska Stat. § 18.80.240, which bars disability discrimination in rentals, and the Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B).

1

State Law Has No Accommodation Clause

Section 18.80.240 has no express reasonable-accommodation clause. The commission's only animal rule, 6 AAC 30.610, covers trained service animals and preserves federal fair housing rights.

2

Is There an Alaska ESA Registry?

No. The state keeps no ESA list, ID card or certificate. Sites selling registration offer nothing a landlord has to recognize. A licensed clinician's letter is what matters.

3

Who Can Write an Alaska ESA Letter?

No state law names ESA letter writers. Telehealth licensing law does matter: AS 08.02.130(a) lets in-state licensed counselors, psychologists, social workers, family therapists, physicians, PAs and nurses treat patients remotely. So an Alaska-licensed clinician should evaluate you.

4

Pet Deposits Are Legal in Alaska

Alaska Stat. § 34.03.070(h) allows an extra deposit of up to one month's rent for any pet that is not a trained service animal. You can still ask for a waiver.

5

Homes, Not Stores or Planes

ESAs have no public-access rights here. The Alaska State Commission for Human Rights says emotional support animals are not service animals under state or federal law, so shops and restaurants can turn them away.

YOUR HOUSING RIGHTS

Emotional Support Animal Housing Rights in Alaska

Nearly every landlord here falls under § 18.80.240. Landlords generally have to consider an accommodation request in good faith, but HUD's May 2026 memo makes outcomes less certain.

WHAT YOU CAN ASK FOR
✓

A No-Pets Rule Can Bend

Ask in writing for an exception to a no-pets, breed or size rule, and attach your letter. Landlords generally have to weigh that request in good faith.

✓

Ask to Waive the Pet Deposit

Since state law allows the deposit, you request a waiver as a disability accommodation under the FHA or § 18.80.240(2). HUD withdrew its no-fee guidance effective September 17, 2025.

✓

Deposit Protections Still Apply

A pet deposit is capped at one month's rent, held separately and usable only for pet damage. It comes back within 14 or 30 days (§ 34.03.070(g)).

✓

No Disability Questions for Applicants

Section 18.80.240(3) bars landlords from asking applicants about a disability. When you request an accommodation, share only what supports it, not your full medical history.

WHERE LANDLORDS CAN SAY NO
×

Unsafe or Destructive Animals

The state statute has no direct-threat text, but FHA doctrine, which the commission treats as instructive (6 AAC 30.910(b)), lets a landlord refuse an animal posing a direct threat or substantial damage.

×

Rooms in the Owner's Home

The only state housing carve-out is a room in a home the owner lives in and shares with you (6 AAC 30.990(b)).

×

Federal Exemptions Don't Carry Over

The FHA exempts some owner-occupied fourplexes and small landlords. Section 18.80.240 has no such exemption, so a landlord exempt under federal law is still covered by state law.

AIR TRAVEL

Can Your ESA Fly Out of Alaska?

Not as an ESA. Under the Department of Transportation's Air Carrier Access Act rule, effective January 11, 2021, airlines may treat emotional support animals as pets. Pet fees, carrier rules and size limits can apply.

The state Human Rights Commission's 2025 service-animal brochure still says the ACAA protects ESAs on flights. That line is out of date, so do not rely on it at the gate. Check your airline's current pet policy before you book.

If your dog is trained to do specific tasks for a psychiatric disability, it may qualify as a service dog instead. Ask about our PSD letter, which is written for trained psychiatric service dogs.

MYTHS AND PENALTIES

Alaska Service Dog Laws and ESA Myths Explained

The state has no crime for misrepresenting an ESA or a service animal, whatever several websites claim. Here is what Alaska service dog laws and the rental statutes actually say.

The facts behind common claims:

⚠️
The Impersonation Claim:Some sites cite AS 11.46.570, criminal impersonation. It covers false identities, never mentions animals, and our research found no case applying it to one.
⚠️
The Service Dog Statutes:AS 11.76.130 makes it a class B misdemeanor to keep a certified service animal out of a business or common carrier. AS 11.76.133 covers interference with animals in training. Neither punishes a false ESA claim.
⚠️
The Deposit Myth:Many vendor pages say landlords here cannot charge ESA deposits. The state's own statute, Alaska Stat. § 34.03.070(h), allows one. Only an individually trained service animal is exempt under subsection (i)(2).
⚠️
The One-Year Letter Myth:No state statute or regulation sets an expiration date for an ESA letter. Honesty still matters: a request built on false statements gives a landlord solid grounds to deny it.
