ESA LETTER HAWAII
What Does an ESA Letter Do in Hawaii?
An ESA letter is a signed statement from a licensed mental health professional who has evaluated you. It verifies that you have a disability and that your animal eases its symptoms. It supports a reasonable accommodation request under Hawaii law and the Fair Housing Act.
Hawaii keeps no ESA registry, and no ID card or official certificate carries legal weight. Landlords look at the clinician's letter.
PetESALetter charges $99 flat. The eligibility quiz is free. If the clinician finds you don't qualify, you get a full refund.

Who Qualifies for an ESA Letter?
Hawaii law defines a disability as an impairment that substantially limits one or more major life activities, such as sleeping, working or concentrating (HRS § 515-2). A clinician looks for that kind of limit, not a wish to keep a pet. Your animal does not have to be a dog, either. Conditions clinicians often evaluate include:
Hawaii ESA Laws: What Does HRS § 515-3 Protect?
More than most states' laws do. HRS § 515-3(b), added by Act 154 in 2022, defines an assistance animal to include emotional support animals. The federal Fair Housing Act adds a second layer.
Untrained ESAs Are Covered
The statute says ESAs may be trained or untrained and need not be dogs. HCRC's own rule, HAR § 12-46-306, uses an emotional support rabbit as its example.
Who Can Write the Letter
Your treating health care professional, mental health professional or social worker can verify your need. Hawaii law sets no minimum treatment period and no license-number rule for the letter.
No Psychology Compact in Hawaii
Hawaii has not enacted PSYPACT or the Counseling Compact, so out-of-state psychologists cannot rely on a compact privilege here. We match residents with clinicians licensed in Hawaii.
After the May 2026 HUD Memo
HUD's May 22, 2026, memo limits its own findings to trained animals but leaves the FHA and Hawaii law unchanged. HCRC's flyer, revised May 28, 2026, still covers ESAs.
Online Registrations Don't Count
Under § 515-3(a)(9), vests, tags and registration documents commonly bought online are not valid verification. Hawaii has no ESA registry at all. A letter from a clinician who evaluated you is what a landlord can rely on.
Emotional Support Animal Housing Rights in Hawaii
Two laws protect you at once: the FHA, 42 U.S.C. § 3604(f)(3)(B), and HRS chapter 515. The points below come mostly from Hawaii's statute and the matching HCRC rules.
A Reasonable Accommodation
A landlord generally has to make a reasonable exception to a no-pet rule. HAR § 12-46-306 still allows leash, cleanup and damage rules.
No Extra Pet Deposit
HRS § 521-44(b)(1)(B) says the extra pet deposit shall not be required for an assistance animal. HCRC treats a monthly pet fee for one as discrimination. Real damage is still yours.
Your Diagnosis Stays Private
If your disability or need isn't obvious, a landlord may ask for verification. By statute, they cannot request medical records or ask about your diagnosis, or the nature or severity of your condition.
Any Reasonable Request Format
HCRC lists requiring a request only in writing, on specific forms, as unlawful. No law sets a reply deadline, so follow up and keep copies.
A Direct Threat
This specific animal threatens others' safety or would cause serious property damage, and reasonable limits, such as leash or control rules, would not fix the problem.
No Reliable Verification
Your disability or need isn't obvious, and you offer no letter from a treating professional, or only an online registration, vest or tag. The landlord can then wait for proper verification.
Small Owner-Occupied Rentals
HRS § 515-4 exempts only an owner living in a two-family building, or one renting up to four rooms in their own home. Owners renting out a house they don't occupy are covered.
TRAVEL RULES
Can You Fly an ESA to Hawaii?
Only as a pet. Since January 11, 2021, the DOT's Air Carrier Access Act rule lets airlines treat ESAs as pets, so an ESA letter gives no cabin rights.
Landing is harder. The Department of Agriculture and Biosecurity applies its dog and cat import rules to every animal, with no ESA exemption.
Direct Airport Release in Honolulu needs a rabies shot 30+ days before arrival, a passing FAVN test plus a 30-day wait, paperwork 10 days ahead and a $185 fee. Otherwise, quarantine can last up to 120 days.
Hawaii Service Dog Laws and Misrepresentation
Hawaii has no penalty law aimed at ESAs, and vendor claims of jail time or $2,000 fines are wrong. Its only misrepresentation law covers passing off an animal as a trained service dog.
What misuse can actually cost you:

Only for a lawful reason: a direct threat from the animal, no reliable verification, or a small owner-occupied rental exempt under HRS § 515-4. A no-pet policy is not enough.
Many do. Hawaii law lets them ask for verification when your need isn't obvious, but not for medical records or your diagnosis.
A mental or emotional condition that substantially limits a major life activity, plus a clinician's finding that the animal eases your symptoms. The clinician decides case by case.
No. HRS § 521-44(b)(1)(B) bars the extra pet deposit for an assistance animal. HCRC also treats monthly pet fees for assistance animals as discrimination.
One year, since Act 56 took effect May 28, 2026; it was 180 days. File with the Hawaii Civil Rights Commission first. State lawsuits have two years (HRS § 515-9(b)).
Yes. ESAs get no exemption from the state's dog and cat import rules. Start the rabies shot and FAVN test months before you move.
