ESA LETTER WASHINGTON STATE

What Is an ESA Letter in Washington State?

Sample emotional support animal letter for Washington State renters

An ESA letter is a short housing letter from a licensed mental health professional who has evaluated you. It states that you have a disability and a related need for your emotional support animal. It is not a certificate or an ID card, and Washington has no official ESA registry.

Washington has no ESA statute. Instead, two laws require housing providers to weigh reasonable accommodation requests: the federal Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), and the Washington Law Against Discrimination.

Our emotional support animal letter in Washington State costs $99 flat. A Washington-licensed clinician decides whether you qualify after a real evaluation.

WASHINGTON LAW

Washington State ESA Laws: What State Law Covers

Washington has no ESA-specific statute. Your housing rights come from the state's disability law and guidance from its civil rights agency.

1

The Accommodation Duty

RCW 49.60.222(2)(b) makes it discrimination to refuse reasonable accommodation to a person with a mental disability.

2

Training Rule Skips Housing

RCW 49.60.040(25) says a service animal must be trained, then states that definition does not apply to housing.

3

Agency Guidance Names ESAs

The Human Rights Commission's 2019 guide says fair housing law would include emotional support animals as reasonable accommodations.

4

Housing Only, Not Stores

Stores and restaurants may exclude an animal whose only job is emotional support.

5

Seattle Goes Further

Seattle's code counts ESAs as service animals, and the city bars pet deposits, pet rent and breed limits for them.

LANDLORD RULES

Can a Washington State Landlord Deny an Emotional Support Animal?

Usually not without a valid reason. Landlords generally have to grant a reasonable accommodation when a tenant has a disability and a related need for the animal. They may refuse an animal that poses a real safety threat or would cause major damage. Some small landlords are exempt: an owner renting out three or fewer single-family houses without a broker, or an owner living in a building of four units or fewer.

WHAT A LANDLORD MAY ASK FOR
✓

A Letter, Not Records

If your disability isn't obvious, a landlord may ask for reliable proof of your need. WAC 162-38-110 bars questions about personal matters beyond what the tenancy requires.

✓

One Request per Animal

Your landlord may ask you to show a need for each animal. If you have two ESAs, your clinician addresses both of them in your letter.

✓

Real Safety Risks

A useful benchmark is WAC 162-38-105, Washington's removal rule for service animals. It requires a risk that is immediate or reasonably foreseeable, and mere annoyance does not count.

✓

You Still Pay for Damage

An ESA letter doesn't cover harm your animal causes. A landlord may bill you for real damage or deduct it from the standard deposit that every tenant pays.

RED FLAGS TO PUSH BACK ON
×

Demand a Registry ID

No official ESA registry, ID card or certificate exists in Washington or any other state. A demand for one has no legal basis.

×

Charge ESA Pet Fees

The Human Rights Commission's guidance says no pet fee should apply. WAC 162-38-100 bans pet deposits for trained service animals, and Seattle expressly extends that protection to ESAs.

×

Require a Liability Waiver

WAC 162-38-120 bars landlords from making a tenant with a service animal waive rights or sign a hold-harmless agreement. ESA tenants can point to the same rule by analogy.

AIR TRAVEL

Can You Fly With an Emotional Support Animal From Washington?

Not as an ESA. The DOT's 2020 Air Carrier Access Act rule took effect on January 11, 2021, and it lets airlines treat emotional support animals as pets. The same rule applies at Seattle-Tacoma, Spokane, Bellingham and every other U.S. airport.

In practice, most airlines now apply their regular pet policy to an ESA. Plan for carrier size limits, a pet reservation and a pet fee. An ESA letter gives you no right to keep your animal in the cabin, however well it is written. Its job is housing, and that is where it carries weight.

Washington State Ferries sets its own rules, so check its current pet policy before you sail. If you need your dog beside you on a flight, look into a psychiatric service dog instead. A PSD is individually trained to perform tasks tied to a disability. PetESALetter offers a separate PSD letter for dogs with that training.

MISREPRESENTATION RULES

Is Faking an ESA Illegal Under Washington Service Dog Laws?

Washington has no fine aimed at ESA letters, but fake paperwork is still a bad idea. The state fines people who pass off a pet or ESA as a trained service animal. A letter from a site that never evaluated you can also sink your housing request.

What the Law Says:

⚠️
Service Animal Fines:UnderRCW 49.60.214, misrepresenting an animal as a trained service animal to secure disability access rights is a civil infraction with a fine of up to$500per infraction.
⚠️
Not an ESA Law:That fine targets service animal claims, mostly in stores and restaurants. It does not reach an honest ESA housing request, and no Washington law sets a separate ESA fraud fine.
⚠️
Lease Consequences:Washington landlord-tenant law still lets landlords enforce reasonable conduct and safety rules. A letter with no real evaluation behind it is easy to question and can undercut your request.
⚠️
Harm to Real Needs:Fake letters make landlords more skeptical of every ESA request, including those from renters with genuine mental health needs.

FAQs

Emotional Support Animal Letter FAQs

Take the free quiz, then talk with a licensed mental health professional. If they find a disability-related need for your animal, they write your letter.

Yes, in limited cases, such as a real safety threat or major damage. Owners living in a building of four or fewer units are exempt under RCW 49.60.222(2).

Get it from a licensed clinician after a real evaluation. It should list the clinician's name, license type, license number, state and date.

Yes. No Washington statute or rule says which licensed provider must write one, so a doctor who knows your condition can.

In May 2026, HUD said it will find cause only in cases with trained animals. That is an enforcement policy, not a change to the Fair Housing Act. Private lawsuits remain open, and you can file with Washington's Human Rights Commission within one year (RCW 49.60.230).

A licensed clinician must find a mental or emotional disability and a related need for the animal. Washington defines disability broadly, including emotional or mental illness.

Many do, often by checking the clinician's license number. Our support team also answers landlord questions.

No. Washington has no official ESA registry, and online registries or free ESA letter templates carry no legal weight. You need a licensed clinician's letter.
