ESA LETTER UTAH

What Is an Emotional Support Animal Letter in Utah?

ESA letter Utah banner

An ESA letter is a signed letter from a licensed mental health professional. It shows that you have a disability and that your animal eases its symptoms. You give it to your landlord to request a housing accommodation under the Fair Housing Act and state law. Ours costs $99, and Utah has no official ESA registry.

An emotional support animal needs no task training. The state code, at § 26B-6-801(6), calls it a "support animal" and ties that term to federal law. Trained service dogs fall under separate rules, and that split decides where your animal can go with you.

SEE IF YOU QUALIFY

Who Qualifies for an ESA in Utah?

The state fair housing law (§ 57-21-2) defines a disability as an impairment that substantially limits major life activities. A licensed clinician decides, after an evaluation, whether your animal eases the symptoms. Conditions clinicians often assess include:

Generalized anxiety disorder
Major depression
Post-traumatic stress (PTSD)
Panic disorder or frequent panic attacks
Bipolar disorder
Social anxiety or specific phobias
Obsessive-compulsive disorder (OCD)
Adjustment disorders after major stress
Autism spectrum disorder
Sleep problems linked to mental health
A diagnosis alone does not mean you qualify. Your clinician looks at how symptoms affect your daily life and whether your animal truly helps.
UTAH ESA LAWS

Utah ESA Laws: What Can Landlords Ask For?

Utah ESA laws draw on three sources: the federal Fair Housing Act, the Utah Fair Housing Act, and a state assistance-animal rule.

1

The FHA Still Covers ESAs

The federal Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), still requires reasonable accommodations for disabilities. HUD's 2026 memo changed enforcement, not the statute.

2

Utah Has Its Own ESA Rule

Some sites say the state has no ESA law. It does: Utah Admin. Code R608-1-17 names emotional support animals as assistance animals. The Labor Commission renewed it January 8, 2026.

3

No Pet Deposits by Statute

Added by 2019 HB 43, § 26B-6-803(1)(b) bars an "extra fee or deposit" for a support animal. Landlords may still recover reasonable repair costs.

4

Utah Wants a Letter, Not ESA Registration

Landlords may ask for documentation from a "physician, psychiatrist, or other qualified healthcare professional." No government agency runs emotional support animal registration, and your medical records stay private.

5

When a Landlord Can Say No

A landlord can refuse for an undue burden or a direct threat. Section 57-21-3 also exempts renting a room in an owner-occupied home and some single-home landlords.

YOUR RIGHTS

Emotional Support Animal Housing Rights in Utah

The federal Fair Housing Act and the state clause, § 57-21-5(4)(b), point the same way. Here is what an emotional support animal owner in Utah can expect from a covered landlord.

WHAT HOUSING PROVIDERS GENERALLY HAVE TO DO
✓

Consider Every ESA Request

A landlord who gets your request should weigh it and answer within a reasonable time. UALD guidance says you can ask out loud or in writing, on any form, and even during an eviction. Federal law sets no fixed deadline.

✓

Answer Without Undue Delay

UALD warns that an undue delay in answering a request can count as a failure to accommodate.

✓

Waive No-Pet Rules

A no-pets clause is exactly the kind of rule that a reasonable accommodation can set aside.

✓

Drop Size and Weight Limits

UALD guidance tells landlords not to apply pet size or weight limits to assistance animals, including emotional support animals.

WHAT HOUSING PROVIDERS SHOULD NOT DO
×

Charging Pet Fees or Deposits

Pet fees are out, but a general cleaning deposit is fine if every resident pays it.

×

Demanding Medical Records

UALD tells landlords not to ask for details about your disability or for your medical records.

×

Interfering With Your Rights

Section 26B-6-805(1) makes denying or interfering with these rights a Class C misdemeanor. Civil penalties under § 57-21-11 can reach $10,000 for a first offense.

TRAVEL RULES

Can Your ESA Fly or Go Into Stores? Utah Service Dog Laws Explained

Not by right. Under the DOT's 2020 Air Carrier Access Act rule, in effect since January 11, 2021, airlines may treat emotional support animals as pets. An ESA letter does not give your animal a cabin seat, so check your airline's pet policy and fees before you book.

Utah service dog laws, §§ 26B-6-802 and 26B-6-803, give public-access rights to service dogs only. Section 26B-6-801(4)(b) excludes animals used solely for emotional support, so stores and restaurants can say no. If your dog is task-trained, ask about a PSD letter instead.

Moving within the state? One statewide rule applies. Section 57-21-2.5 preempts local housing-discrimination ordinances, so Salt Lake City and other cities cannot set their own ESA housing rules.

FRAUD PENALTIES

Is Faking an ESA a Crime in Utah?

Yes. The state treats a fake ESA claim as a crime, not just a lease problem. The rule, once numbered 62A-5b-106, now sits inUtah Code § 26B-6-805.

What misuse can lead to:

⚠️
Lease Violations or Eviction:A landlord who learns that a letter is fake can treat the animal as an unapproved pet. That can mean lease violations, pet charges, or an eviction case.
⚠️
Criminal Charges:Knowingly and intentionally telling someone that an animal is a service or support animal when it is not is aClass C misdemeanor, with a maximum of 90 days in jail and a $750 fine.
⚠️
Lying to Your Clinician:Section 26B-6-805(2)(b) also makes it a crime to misstate a material fact to a health care provider to get support-animal documentation.
⚠️
Trouble on Future Applications:An eviction case or a fraud dispute can surface when you apply for your next home. It also hurts renters who rely on honest ESA letters.

FAQs

Utah ESA Letter Questions, Answered

Yes, but only on narrow grounds. Under Utah Admin. Code R608-1-17, a landlord can refuse for an undue burden or a direct threat, like a dangerous animal. Some small owner-occupied rentals are also exempt.

The state rule accepts documentation from a physician, psychiatrist, or other qualified healthcare professional. No Utah ESA statute or rule says the writer needs an in-state license. We still match residents with clinicians licensed in Utah.

They can. A landlord may confirm that the clinician holds a valid license and that the letter is genuine. Our team answers those verification questions.

The Fair Housing Act itself did not change. HUD withdrew its 2013 and 2020 animal notices, and a memo dated May 22, 2026, says HUD will find cause only for trained animals. Utah's rule still names emotional support animals, and private lawsuits remain open.

File with the Utah Antidiscrimination and Labor Division within 180 days to keep your case with the state agency (§ 57-21-9). Complaints filed on days 181 to 365 go to HUD. You can also sue within 2 years (§ 57-21-12).

Complete a real evaluation with a licensed clinician, and skip sites that sell registration kits or ID cards. Answer honestly, because lying to a clinician for a letter is a crime here.
