Colorado ESA Law: The State Framework

Colorado law now expressly addresses emotional support animals in housing. HB26-1045, effective August 12, 2026, codifies elements of the earlier federal assistance-animal framework in state law.

State Accommodation Rules

Under C.R.S. § 24-34-502.2(2)(b), permitting an assistance animal is presumed reasonable when an interactive process occurred, while a complete prohibition is presumed discriminatory, subject to the statute’s terms.

Fees and Animal Damage

Colorado law treats an assistance-animal request differently from ordinary pet treatment. The tenant may remain responsible for damage actually caused by the animal.

Colorado ESA Travel Information

A Colorado housing accommodation does not turn an ESA into a service animal for air travel. Airlines can apply their own pet rules, including fees, carrier requirements, reservation limits, health records, and cabin-size restrictions.

The 2026 Colorado housing law addresses accommodations in housing, not airline cabin access, airport access, or general transportation access. Always separate a housing request from a travel reservation.

For rideshares, trains, hotels, and other travel, check the company policy before making plans. An ESA does not gain public-access rights simply because it supports a housing request in Colorado.
