ESA LETTER NEW HAMPSHIRE
What Is an ESA Letter in New Hampshire?
An ESA letter is a signed statement from a licensed mental health professional. It confirms you have a mental or emotional disability that your animal helps ease. It is not an ID card or certificate.
It backs a reasonable accommodation request under the Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), and New Hampshire's Law Against Discrimination, RSA 354-A:11, III(b). There is no separate state ESA statute.
No official ESA registry exists anywhere. An emotional support animal letter New Hampshire landlords can verify costs $99 flat with us. ESAs get housing rights only, not public access.

New Hampshire ESA Requirements: Who Qualifies?
Eligibility turns on impact. A licensed clinician asks whether a mental or emotional condition substantially limits a major life activity, such as sleep, work or time with other people. That matches the disability definition in RSA 354-A:2, IV.
A diagnosis alone settles nothing. How your animal actually helps matters too.
New Hampshire ESA Laws: What the RSAs Actually Say
New Hampshire ESA laws are thin. No RSA defines emotional support animals for housing, and the few sections that mention emotional support do so to exclude it.
One Clause Does the Work
RSA 354-A:11, III(b) makes refusing a needed, reasonable accommodation a civil rights violation. It has no training test.
ESAs Are Not Service Animals
RSA 167-D:2, II says emotional support is not “work or tasks,” so ESAs get no public access.
No 30-Day Rule Here
State law sets no waiting period. Telehealth clinicians need an NH license or compact privilege (RSA 310:7, III).
Comfort Dogs Are Different
New RSA 167-E, effective August 31, 2026, says public-safety comfort dogs are neither service dogs nor ESAs.
No State Expiration Date
No NH statute or rule sets a validity period for ESA letters, despite claims of a 12-month state limit.
Can a New Hampshire Landlord Deny an Emotional Support Animal?
Rarely. Covered landlords generally have to grant a reasonable accommodation. HUD's 2026 memo changed its enforcement, not 24 C.F.R. § 100.204.
Waiving a No-Pet Policy
Your letter backs a request to set aside a no-animals rule for you, even in a building advertised as pet-free.
Deposits Face a State Cap
Any refundable pet deposit must fit inside the one-month security deposit cap (RSA 540-A:5, II; 540-A:6, I(a)).
Fees: Ask, Don't Assume
No NH law bans ESA pet fees or pet rent; HB 1553, a 2026 pet-fee bill, died. Ask for a waiver in your request.
Deposits Back Within 30 Days
Covered landlords must return deposits within 30 days after the tenancy ends, or they can owe double (RSA 540-A:7, I; 540-A:8, I(b)).
Asking for Proof
No NH rule governs verification. When your need isn't obvious, expect a request for reliable documentation and a license check.
Small Owner-Occupied Buildings
RSA 354-A:15 exempts owner-occupied buildings of up to four units and rooms in an owner's home. Its reach to accommodation claims is untested.
Real Safety or Damage Risks
RSA 354-A:11, XI lets a landlord refuse where a tenancy poses a direct threat or substantial property damage.
TRAVEL RULES
Does an ESA Letter Help You Fly?
Not for cabin access. Under the DOT's Air Carrier Access Act rule, in effect since January 11, 2021, airlines may treat emotional support animals as pets.
Plan for pet fees, carrier rules and cabin limits. Your New Hampshire letter covers housing only.
Read your airline's pet policy before you book. Separate DOT rules cover trained psychiatric service dogs, so ask about our PSD letter if your dog is task-trained.
New Hampshire Service Dog Laws: What Counts as Misuse?
No state statute makes a false ESA request or letter a crime. New Hampshire service dog laws are stricter. Passing an ESA off as a service dog can lead to a criminal charge.

FAQs
ESA Letter FAQs for NH Renters
Only in limited cases. A landlord may refuse an animal that poses a direct threat or would cause substantial property damage (RSA 354-A:11, XI). Some small owner-occupied buildings may be exempt.
Many do, and some check the clinician's license. For a telehealth letter, the clinician must hold an NH license or a compact privilege (RSA 310:7, III).
File with the NH Commission for Human Rights, 603-271-2767, within 180 days (RSA 354-A:21, III). After 180 days on file, you may sue in superior court within three years (RSA 354-A:21-a).
No state law bans it. But any refundable deposit counts toward the cap of one month's rent or $100, whichever is greater. Some small landlords are outside these rules unless you are 60 or older.
Yes, for a trained service dog. RSA 167-D:4 lets it enter public places and housing with its handler. ESAs get no such access under RSA 167-D:2, II.
