ESA LETTER KENTUCKY

What Is an Emotional Support Animal Letter in Kentucky?

Kentucky renter relaxing at home with an emotional support dog

An ESA letter is a signed statement from a licensed clinician who has evaluated you. It supports a housing accommodation request under the Fair Housing Act and Kentucky's ESA law, KRS 383.085.

Kentucky has no official ESA registry, ID card or certificate. You pay $99 at checkout, and you get a full refund if the clinician finds you don't qualify.

Under KRS 383.085, paperwork from a site whose main service is selling documents does not count. The evaluation is what matters.

THE PROCESS

How Do You Get an ESA in Kentucky?

Four online steps take you from a free quiz to a clinician's decision. No office visit, no waiting room and no registry.

1 Free eligibility quiz icon

Take the Free Quiz

Share how stress, sleep problems or low mood affect your days, and tell us about your animal. The five-minute quiz is free and private. It helps your clinician prepare.

2 Video consultation icon

Meet a Kentucky Clinician

At checkout, you pay $99. Then a Kentucky-licensed clinician meets with you one-on-one by video, phone or secure online visit. KRS 383.085 sets no minimum length for that therapeutic relationship.

3 Clinician decision icon

The Clinician Decides

Your clinician asks real clinical questions in good faith and decides whether you have a disability-related need that an emotional support animal eases. Some people do not qualify, and that call is the clinician's alone.

4 Signed housing letter icon

Get Your Signed Letter

If you qualify, your letter usually arrives within 24–48 hours on professional letterhead, showing the clinician's name, license type and number, state and date, ready for your landlord or property manager.

WHO QUALIFIES

Who Qualifies for an Emotional Support Animal in Kentucky?

You may qualify if a mental or emotional condition substantially limits a major life activity, such as sleeping, working, concentrating or being around people. That is how the Kentucky Civil Rights Act defines disability (KRS 344.010(4)). A diagnosis alone does not decide it. A licensed clinician looks at how your symptoms affect your days and whether living with your animal relieves them. A short quiz cannot make that call. Conditions clinicians often evaluate include:

Generalized Anxiety Disorder
Major Depressive Disorder
PTSD
Panic Disorder
OCD
Bipolar Disorder
ADHD
Social Anxiety Disorder
Adjustment Disorder
Autism Spectrum Disorder
This list is not complete. Other conditions can qualify, and some people with these diagnoses will not. Your clinician makes the final call based on your full clinical picture. If you do not qualify, you can request a full refund within 7 days.
KENTUCKY LAW

Kentucky ESA Laws: What KRS 383.085 Says

Kentucky is one of the few states with a housing statute that names emotional support animals. KRS 383.085, passed as HB 329 in 2018 and amended by HB 411 in 2019, applies statewide. It works alongside the federal Fair Housing Act and KRS 344.360(11)(b), the Kentucky Civil Rights Act's accommodation clause.

1

Is There a Kentucky ESA Registry?

No. The state keeps no emotional support animal registration, database or ID card. Sites selling Kentucky ESA registration offer nothing a landlord has to honor; a clinician's letter is what counts.

2

ESAs Count as Assistance Animals

Section 383.085(1)(a) defines an assistance animal to include one that provides emotional support easing symptoms of a disability. It lists emotional support animals by name, so housing requests need no proof of training.

3

Who Can Write the Letter

Under § 383.085(1)(b), the writer must be a Kentucky-licensed LCSW, professional counselor, APRN, psychologist or physician with an active in-state practice, giving care in good faith. Marriage and family therapists are not listed. New arrivals may keep an ongoing home-state provider.

4

No Pet Fees or Deposits

Section 383.085(4) says a tenant cannot be required to pay a pet fee, pet deposit or additional rent for an assistance animal. As state law, it survived HUD's 2025–2026 changes. You still pay for damage where pet owners would.

5

Kentucky Service Dog Laws Exclude ESAs

KRS 258.500 gives public access only to individually trained assistance dogs. As amended in 2024, § 258.500(16) says nothing requires admitting an emotional support animal to stores, restaurants or theaters. Housing requests go to KRS 383.085 instead.

YOUR RIGHTS

Can a Kentucky Landlord Deny Your ESA?

Only on narrow grounds. The Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), and KRS 344.360(11)(b) treat refusing a reasonable accommodation as discrimination. Landlords generally have to consider your request and grant it unless an exception below applies.

WHAT PROTECTS YOU
✓

No-Pet Rules Can Bend

A no-pet lease clause is a policy, and a reasonable accommodation is an exception to it. With reliable documentation, you can ask your landlord to waive the rule for your emotional support animal under 24 C.F.R. § 100.204.

✓

HUD's 2026 Memo Explained

HUD withdrew its 2013 and 2020 ESA notices. Under its May 22, 2026, memo, HUD finds cause only for trained animals. The Fair Housing Act is unchanged, and KRS 383.085 still covers ESAs.

✓

Landlords May Verify

If your need is not readily apparent, a landlord may ask for reliable documentation, must evaluate it, and may independently check that it is authentic (§ 383.085(2)–(3)). State law sets no response deadline.

✓

Landlord Liability Shield

Worried about insurance? Section 383.085(5) says a landlord is not liable for injuries caused by an assistance animal allowed as a reasonable accommodation. Point a hesitant property manager to it.

WHEN A KENTUCKY LANDLORD CAN SAY NO
×

Direct Threat or Damage

KRS 344.360(14) allows a refusal if the specific animal would be a direct threat or cause substantial physical damage to the property of others.

×

Letters That Don't Qualify

A landlord can discount paperwork from a writer outside the § 383.085(1)(b) list, a provider whose main service is selling documentation, or an out-of-state clinician, unless you moved here and the relationship is ongoing.

×

Small-Landlord Exemption

Kentucky exempts only owner-occupied buildings of two units or fewer, or a room in the owner's home (KRS 344.365). The fee ban has no exemption.

AIR TRAVEL

Can Your ESA Fly With You From Kentucky?

Not as an assistance animal. The U.S. Department of Transportation's Air Carrier Access Act rule, effective January 11, 2021, lets airlines treat emotional support animals as pets. Your ESA letter is a housing document and gives no cabin rights.

Before you book a flight from a Kentucky airport, read your airline's pet policy. Expect pet fees, carrier size limits and cabin caps that vary by airline.

Psychiatric service dogs are trained for specific tasks and fly under different rules. If that fits your dog, ask about our PSD letter.

MISREPRESENTATION

What Happens If You Misrepresent an ESA in Kentucky?

Kentucky's ESA law penalizes both sides of a fake letter. A renter who lies about a disability faces a fine, and so does anyone who sells documentation mainly for a fee. That is why a good-faith clinical evaluation matters so much here. UnderKentucky Revised Statutes § 383.085(6)–(7), knowingly misrepresenting an assistance animal is a fine-only violation, not a crime, with a penalty of up to$1,000.

What § 383.085(6) counts as misrepresentation:

⚠️
Lying to Get a Letter:Knowingly misstating a disability or need in a housing request, or making materially false statements to obtain documentation, falls under paragraphs (a) and (b).
⚠️
Vests and Signs:Buying an ESA vest online does not make an animal an assistance animal. Fitting a harness, vest or sign on one that isn't counts under paragraph (d).
⚠️
Letter Sellers Face Fines:Paragraphs (c), (e) and (f) reach the provider too, including anyone who supplies documentation for the primary purpose of obtaining a fee. The law aims squarely at letter mills.
⚠️
Stores and Restaurants:Claiming your ESA is an assistance dog to get into a public place is a separate violation. KRS 258.335(2) and 258.991(2), in force since July 15, 2024, carry a fine of up to $1,000.
