ESA LETTER SOUTH DAKOTA
What Does an ESA Letter Do in South Dakota?
An ESA letter is a signed statement from a licensed mental health clinician. It confirms that you have a mental or emotional disability and that your emotional support animal eases its effects. You share it with your landlord.
Your request rests on the federal Fair Housing Act and the South Dakota Human Relations Act (SDCL § 20-13-23.7). Landlords generally have to consider a reasonable accommodation in good faith, and state law sets the paperwork rules.
No official ESA registry exists. At PetESALetter, an emotional support animal letter for South Dakota housing costs $99 flat.
How to Get Your ESA Letter
Everything happens online. The quiz is free, and your clinician holds a South Dakota license, which the state's telehealth law generally requires for remote care (SDCL § 34-52-2).
Take the Free Quiz
Tell us how symptoms shape your sleep, work and relationships, and what your animal does for you. It takes about five minutes.
Talk With Your Clinician
A mental health professional licensed in South Dakota reads your answers, then speaks with you directly by video or phone, or in a secure online visit.
An Honest Evaluation
The clinician looks at how your condition limits daily life and whether the animal helps. Not everyone qualifies, and the decision is clinical, not automatic.
Get Your Signed Letter
If you qualify, the letter usually arrives within 24–48 hours of the evaluation. It is signed, dated and ready to send to your landlord.
Who Qualifies for an ESA?
State law defines disability as a physical or mental impairment that substantially limits one or more major life activities (SDCL § 43-32-33). Clinicians often evaluate conditions like these:
South Dakota ESA Laws: What the 2018 Statute Says
South Dakota ESA laws name emotional support animals directly. Senate Bill 119 (2018) became SDCL §§ 43-32-33 to 43-32-36, and those sections have not changed since. They cover paperwork and fraud, not fees. Here is what they and related laws mean:
ESAs Are Named in § 43-32-33
For these rental sections, “service animal” includes an emotional support animal. The duty to accommodate comes from § 20-13-23.7: good-faith efforts unless that causes undue hardship.
No State Pet Fee Ban
No state statute bars ESA pet fees or pet rent. You can ask for a waiver as a reasonable accommodation, but approval is not automatic.
Stores and Restaurants Can Refuse
Public access belongs to service animals “especially trained for the purpose” (§ 20-13-23.2). An untrained ESA has no right to enter shops, restaurants or hotels.
South Dakota ESA Letter Requirements
Under § 43-32-35, any licensed health care provider can confirm your disability and need. The one bar: providers who operate here solely to sell animal paperwork.
180 Days to File a Charge
If a landlord wrongly refuses, file with the Division of Human Rights within 180 days (§ 20-13-31). The state is not on HUD's FHAP list.
Can a Landlord Refuse an Emotional Support Animal in South Dakota?
Sometimes. Landlords generally have to consider and grant a reasonable accommodation under the Fair Housing Act, 42 U.S.C. § 3604(f)(3)(B), and state law. Each side still keeps certain rights.
Ask for Supporting Documentation
Under § 43-32-34, a landlord may ask for reliable documentation, but not when your disability or need is readily apparent or already known.
Refuse for Undue Hardship
The state duty is good-faith effort, not unlimited. A landlord may decline an accommodation that would impose undue hardship under § 20-13-23.7.
Deduct for Real Damage
Damage your animal causes beyond ordinary wear and tear can come out of the deposit, like any tenant's damage (§ 43-32-24).
Owner-Occupied Duplexes Are Exempt
State fair housing law exempts a two-family dwelling where the owner lives in one unit, plus dorms and Greek houses (§ 20-13-20). Most other rentals are covered.
Reject a Letter for Telehealth Alone
Sections 43-32-33 to -36 do not ban telehealth letters or demand a certain specialty. Lawmakers tried to restrict online letters in HB 1218 (2023) and HB 1231 (2026). Both bills failed.
Break Deposit Rules
Pet deposits count toward the one-month-rent cap (§ 43-32-6.1). Since July 1, 2026, the return deadline is 21 days after the lease ends and you give a mailing address.
Require ESA Registration
There is no emotional support animal registration in South Dakota or at any federal agency. Online ID cards, vests and certificates prove nothing, and landlords may reject them.
AIR TRAVEL
Can Your ESA Fly in the Cabin After the 2021 DOT Rule?
Only as a pet, if the airline allows it. The Department of Transportation's Air Carrier Access Act rule took effect January 11, 2021. Since then, airlines may treat emotional support animals as ordinary pets, with fees and carrier limits.
Your ESA letter supports a housing request. It gives no cabin rights, and it does not open doors at hotels, stores or restaurants either.
If your dog is trained to perform tasks for a psychiatric disability, a PSD letter may fit better. Check your airline's policy before booking.
South Dakota Service Dog Laws: What Happens If You Fake One?
South Dakota service dog laws tightened on July 1, 2026, and the rental fraud rules date back to 2018. Both punish knowing lies, not honest requests. A real need is never the problem; faking one is.

FAQs
South Dakota ESA Letter FAQs
Some do. Section 43-32-35 requires a licensed health care provider, not a paperwork seller, so some landlords check. Our team answers verification questions.
Get evaluated by a licensed clinician with a real practice. Registry sites do not meet South Dakota's documentation rule.
It can. Anxiety qualifies when a licensed clinician finds it substantially limits daily life and the animal helps. A diagnosis alone is not enough.
No. A veterinarian treats your animal, not you. The letter must confirm your disability, which takes a licensed health care provider who evaluates you.
No. HUD itself now finds cause only for trained animals, but the Fair Housing Act is unchanged. Private lawsuits and § 20-13-23.7 still apply.
