ESA LETTER DELAWARE
What Does an Emotional Support Animal Letter Do in Delaware?
An emotional support animal letter in Delaware is a signed statement from a licensed mental health professional. It confirms that you live with a mental or emotional disability and that your animal eases its symptoms. You hand it to a landlord with a request to keep the animal in a no-pet home.
That request rests on two laws: the federal Fair Housing Act (42 U.S.C. § 3604(f)(3)(B)) and the Delaware Fair Housing Act, 6 Del. C. § 4603A(a)(2). Neither one says an emotional support animal needs training.
Delaware keeps no ESA registry, and no state office issues ESA ID cards. Paid online registrations carry no legal weight. PetESALetter charges $99 flat for a housing letter from a licensed clinician.

Do You Qualify for an Emotional Support Animal in Delaware?
Delaware law uses a broad test: a physical or mental impairment that substantially limits one or more major life activities (6 Del. C. § 4502(20)). Sleep, work, focus and relationships all count.
Common conditions a clinician may consider include the following:
Delaware ESA Laws: What the Statutes Actually Say
Many websites overstate Delaware ESA laws. No Delaware statute even mentions emotional support animals, so your rights come from fair housing law. Five points matter most.
Chapter 46 Has No Animal Rule
The Delaware Fair Housing Act never mentions animals. Your request relies on its general accommodation clause, § 4603A(a)(2), and on the federal FHA. Neither law requires training.
The Deposit Exemption Skips ESAs
25 Del. C. § 5514(i)(3) bars pet deposits only for a "duly certified and trained support animal." Section 5141(38) requires individual training, so ESA owners ask for a waiver as an accommodation.
No Questions About Your Diagnosis
Delaware makes it discrimination to ask about "the nature or severity of a disability" (§ 4603A(a)(4)). Your letter confirms a disability-related need; no state law says it must name your diagnosis.
Fee Caps Cover Every Tenant
A pet deposit tops out at one month's rent and must be returned or itemized within 20 days (§ 5514(i)). Section 5311 bans non-refundable move-in fees for every tenant.
Telehealth Care Is Lawful Here
Delaware lets a provider-patient relationship begin through telehealth (24 Del. C. § 6003(a)), with no 30-day waiting rule. PetESALetter pairs you with a clinician licensed in Delaware for a live video or phone evaluation.
Can a Landlord Deny an ESA in Delaware?
Sometimes, but only for narrow reasons, and Delaware law reaches more rentals than federal law does. A covered landlord generally has to consider a reasonable accommodation request and grant it unless an exception applies.
Apartment Buildings
Apartment complexes and managed rentals fall under both the federal FHA and 6 Del. C. ch. 46, whatever their pet policy.
Single-Family Houses
Federal law exempts some owners who rent out three or fewer houses. Chapter 46 has no such exemption, so most Delaware house rentals are covered.
Any Residential Landlord
25 Del. C. § 5116 bars refusing to rent because of disability and lets a tenant recover substitute-housing costs.
Applicants, Not Just Tenants
The inquiry limits in § 4603A(a)(4) apply when you first apply, not only after you move in.
Owner-Occupied Buildings
An owner who lives in one unit of a building with four or fewer units is exempt. It is Delaware's only small-landlord exemption (§ 4607(e)).
Real Threats or Damage
No accommodation is owed if your animal poses a direct threat to others or would cause substantial physical damage (§ 4603A(f)).
Religious Groups and Private Clubs
Religious organizations and private clubs have limited exemptions under 6 Del. C. § 4607(a) and (b).
AIR TRAVEL
Flying, Stores and Delaware Service Dog Laws
Airlines can treat your ESA as a pet. Under the Department of Transportation's Air Carrier Access Act rule, in force since January 11, 2021, expect pet fees and carrier limits.
Your letter is a housing document only. It gives you no cabin rights, so check your airline's pet policy before booking.
Delaware service dog laws protect only a "dog individually trained to do work or perform tasks" (6 Del. C. § 4502(28)). ESAs have no right to enter stores or restaurants.
Is ESA Fraud a Crime in Delaware?
Many ESA sites say Delaware fines people for faking an assistance animal. It does not. The penalty they quote came from a bill that never passed. Here is the accurate picture.

FAQs
Delaware ESA Letter FAQs
Delaware has no ESA-specific statute. Renters rely on the federal Fair Housing Act and the state accommodation clause, 6 Del. C. § 4603A(a)(2). ESAs lack public-access rights, and the state deposit exemption covers only trained animals.
Get evaluated live by a licensed mental health professional. Delaware lets that relationship start by telehealth (24 Del. C. § 6003), but a questionnaire-only letter falls short.
It can. If anxiety substantially limits sleep, work or another major life activity, a licensed clinician may find that an animal helps after evaluating you.
They can ask for one. The § 5514(i)(3) exemption covers only trained animals, so request a waiver as a reasonable accommodation. Deposits are capped at one month's rent, and wrongful withholding costs the landlord double.
Many do. A landlord may check the clinician's license, and our support team answers those questions. Asking about the nature or severity of your disability is off limits (§ 4603A(a)(4)).
Contact the Delaware Division of Human and Civil Rights at (877) 544-8626 within one year of the denial or its discovery (§ 4610). A Superior Court suit is open for two years (§ 4613). HUD's May 2026 memo changes only how HUD itself investigates.
