You don’t need an existing therapist to get a legal ESA letter. What you do need is a one-time evaluation with a licensed mental health professional and that’s a smaller ask than most people assume, because it doesn’t require months of ongoing therapy sessions.

This is where a lot of confusion comes from. People hear that you need a mental health professional and picture years of weekly sessions with a therapist they don’t have and can’t easily find. That’s not actually the requirement. The requirement is a real clinical evaluation by someone licensed to make that judgment which can happen in a single appointment, through telehealth, with a provider you’ve never met before.

What you can’t do is skip the licensed evaluation altogether. That’s the one part of this process no state or federal law allows you to shortcut, and understanding why makes the rest of this much easier to navigate.

Do You Need a Therapist to Get an ESA Letter?

No you don’t need an existing, ongoing therapist. You just need a one time evaluation by the license mental health professional. This include therapists, but also the psychologist, psychiatrist, licensed clinical social workers and also the license counselor who can evaluate you without any prior relationship.

The word therapist makes people think of long- term talk therapy. Legally, what the Fair Housing Act and state laws actually require is documentation from a licensed mental health professional confirming you have a disability related need for the animal. That’s a broader category than just your therapist, and it’s a category you can access even if you’ve never been in therapy before.

Where this gets state-specific and that is a handful of states like California, Montana, Iowa, Louisiana, Arkansas require the provider to have a minimum relationship with you that is generally 30 days before they can issue the letter. In those states, without a therapist then it really means “without an established provider relationship yet,” and the honest fix is starting that relationship early, not skipping it.

Who Can Legally Write Your ESA Letter (If Not a Therapist)?

A valid ESA letter can be written by any licensed mental health professional: a licensed clinical social worker (LCSW), licensed professional counselor (LPC), licensed marriage and family therapist (LMFT), psychologist (PhD/PsyD), or psychiatrist (MD/DO). A general physician can sometimes qualify if they’re actively treating your mental health condition, though this varies by state.

Why Some People Can't Use Their Own Doctor

Many people assume their regular doctor or existing therapist will write the letter, then discover that provider won’t do it and usually because of employer policy, liability concerns, or simply not offering ESA documentation as part of their practice.

This is common enough that it’s worth planning for rather than being surprised by. Large healthcare systems and insurance-based practices often have blanket policies against writing ESA letters, regardless of whether your case is legitimate. It’s not a judgment on you — it’s usually a liability and workflow decision made at the organization level.

Documentation. If approved, you receive a letter with the provider’s name, license number, license type, and a statement of disability-related need.

The entire process can be completed without ever having seen this provider before, in most states. The exception is the small group of states with a mandatory minimum relationship period, covered below.
